BOOKING TERMS & CONDITIONS
1.CONTRACT
The contract for the letting is between the hirer and owner of the property.Any issues, discrepancies or mistakes arising under the contract and booking confirmation should be addressed immediately to Annabel Thomas at info@crowsnestcotswolds.co.uk, or Crow’s Nest, 90 Howell’s Mere, Lower Mill Estate, Somerford Keynes, Cirencester, GL7 6FZ or via the website www.crowsnestcotswolds.co.uk.
The rental contract will not be confirmed until the payment is received in accordance with item 3 below.
2.PERIODS OF HIRE
Weekly rental periods commence at 15.00 on the arrival date and end at 10.30 on the departure date. The hirer’s attention is drawn to the inflexible need for prompt departure as this is essential for cleaning and maintenance between hire periods.
3.PAYMENT
A deposit of 30% of the rental fee is payable immediately the booking is made if this is more than eight weeks before the start date of the rental period.The balance is payable eight weeks before the commencement of the rental.Non-payment of the balance of the rental on or before the due date will constitute cancellation of the contract by the hirer.For bookings made less than eight weeks before the rental commencement date, the total rental is payable to establish the contract.All payments to be made to Crow’s Nest, online by credit or debit card.
Every property booking requires a security deposit of £250.00 to be paid by the Guest as a deposit towards any damage, loss or loss of rental suffered by the Owner as a result of the conduct of a Guest or any member of the Guest’s party or other person authorised to enter the property by the Guest or a member of the Guest’s party.
Guests are required to lodge the security deposit of £250.00 which will be held on the credit or debit card used to pay the balance.This amount will be ring-fenced 5 days prior to the start date of the rental period.The full amount will be released 5 days after the last day of the rental period as long as there have been no damages, loss, etc.
4.CHANGE OF RENTAL DATES
We will consider a request from the hirer to change the booking dates after the hire contract is established.A new contract will be established provided that (a) the property is available for desired rental period, and (b) the hirer immediately pays any additional sum due under clause 3 above if the desired rental period is at a higher rate plus an administrative fee of £25 per booking.
5.CANCELLATION
Any cancellation of the hire contract made by the hirer for any reason shall be in writing addressed to Annabel Thomas.Upon receipt of notice of cancellation, we will endeavour to re-let the property for the rental period and if successful refund the hirer the full amount paid less an administrative charge of £25 per booking.If the property can only be re-let for part of the rental period we will refund the hirer the full amount paid less the rental for the period which is not re-let plus an administrative charge of £25 per booking. If the property cannot be re-let we will retain the full amount paid and the hirer is responsible for obtaining Cancellation Insurance which can be obtained from Insurance Brokers to cover such risks of cancellation losses as the hirer sees fit.If the property is re-let in such a way as incurs extra cleaning expenses, the cost of this will be taken off any re-imbursement.
If cancellation has to be made due to circumstances brought on by a government lockdown because of Coronavirus then every endeavour will be made to find a mutually suitable future date to move the booking to.If this is not possible then a full refund will be made.

6.USE AND OCCUPANCY
The number of people occupying the property must not exceed the number stated in the booking confirmation.The property must be used only for domestic and personal recreation purposes of the contracted hirer and party and no subletting of the contract is permitted.The property shall not be used as a party base or for stag or hen parties or for any commercial purposes whatsoever without the prior written agreement by Annabel Thomas.The property rental is strictly on the basis that no smoking is permitted on any part of the property.We reserve the right to refuse entry to the entire party or to terminate the contract and repossess with immediate effect if the Use and Occupancy conditions are breached in any way.
7.BREAKAGES OR DAMAGE
The hirer must take all reasonable care of the property including furniture, garden furniture, electrical goods, fixtures and fittings, soft furnishings and artworks in or on the property and grounds and leave all in the same state of repair and clean tidy condition as found at the commencement of the rental period.All equipment and white goods in the property shall be operated in accordance with the instructions provided in the property manual.Any breakages and or damage shall be immediately notified to Annabel Thomas.
8.PROPERTY CARE
If any breakdown, malfunction or maintenance item should arise during the hire period, the hirer must immediately notify Annabel Thomas who will endeavour to attend to any matter with reasonable and appropriate urgency.
9.COMPLAINTS
If any cause for complaint should arise during the rental period it should be notified immediately to Annabel Thomas who will endeavour to attend to any matter with reasonable and appropriate urgency.
10.PETS & REGISTERED GUIDE DOGS
Pets are not allowed at the property. Registered guide dogs and hearing dogs belonging to the hirer and party members are permitted in the property strictly on condition that no fouling on the estate is permitted and dogs must sleep in their own bedding provided by the hirer and not on furniture.Because of the resultant additional property cleaning costs an additional charge of £20 per stay is added to the hire charge.To avoid allergy problems strictly no cats are allowed on the property.However, because it cannot be guaranteed to any hirer that no dogs have previously been on the property, we cannot accept liability for any allergic responses which might be suffered as a result of guide dogs or pets having been previously present.The owner cannot accept liability for any damages or losses which might arise from pet or guide dog incidents with farm livestock and horses or failure to comply with the country code.
11.RIGHT OF ENTRY
The owner or his appointed agent shall be allowed the right of entry to the property at all reasonable times to carry out any necessary maintenance or repairs or for purposes of inspection in relation to matters referred to in clauses 6 – 11 above.
12.ELECTRONIC COMMUNICATIONS
For the purposes of the Data Protection Act 1998, Annabel Thomas is the sole data controller of all personal data provided by hirers and prospective hirers for the purpose of processing a booking for the hire of Crow’s Nest apartment.The data collected will of necessity include names and addresses of hirer and party members; payment details; details of special requirements such as those relating to a disability or condition which may affect rental arrangements.We will not make available to any third party any of the personal information or mailing list held electronically by Annabel Thomas and will comply with all relevant data protection legislation.
13.WARRANTIES AND LIABILITY
13.1Annabel Thomas is not responsible for and does not warrant the accuracy of information or statements made by agents and websites outside its control.
13.2Nothing in the Contract limits or excludes the liability of the owner for personal injury or death caused by misrepresentation or negligence.
13.3Subject to Clause 14.2 the Total Liability of the owner to the Hirer under the performance of the contract or otherwise shall be limited to a sum not greater than three times the total rental and additionally the owner shall not be liable to the Hirer for indirect consequential loss or damage or any costs, expenses or other compensation claims whatsoever arising out of or in connection with the Contract.
13.4No term of the Contract is enforceable by any person who is not party to the contract under the Contracts (Rights of Third Parties) Act 1999.
13.5If for unavoidable reasons beyond their reasonable control or Force Majeure the property becomes unusable or unavailable prior to the commencement date of the rental, the total Liability of the owner will be to reimburse the hirer the total sum paid.
13.6Force Majeure applicable to the contract includes without limitation fire, flood, exceptional weather conditions, access prevention due to government or health authority enforcement notices, or any other damage or destruction from any cause except negligence on the part of the owner or his agents.In any such event no compensation, costs or expenses including alternative accommodation costs will be payable by the owner to the hirer.
14.LEISURE AND WELLNESS CENTRE
Please be aware that guests are welcome to use the spa, pool facilities, tennis courts, etc. whilst staying at Crow's Nest or Heron’s Hide.As these amenities are managed by a third party we cannot guarantee their availability at all times and are not responsible for any closures, maintenance, or restricted access during your stay. No refunds or compensation will be provided in the event that these facilities are unavailable.
